Welcome to LOFA. These Terms & Conditions (“Terms”) govern your use of LOFA’s website, services, orders, and other interactions (collectively, the “Services”). By accessing or using our Services, placing an order, registering an account, or otherwise interacting with LOFA, you agree to these Terms. If you do not agree, please do not use the Services.

1. Definitions

  • Company / We / Us / Our: LOFA, including its owners, affiliates, agents, employees.
  • You / Your / Customer / Buyer: Any person who visits, browses, registers, or places an order using our Services.
  • Service(s): LOFA’s website, mobile app (if any), product listings, customer support, etc.
  • Product(s): Any clothing, accessories, goods sold via LOFA.
  • Order: A confirmed purchase request placed by You via the LOFA site, subject to acceptance.
  • Registered User: A Customer who has created an account with us.

2. Eligibility & Account

  • You must be at least 18 years old, or have parental / legal guardian consent, to use the Services or enter a binding contract with us.
  • You warrant that all information provided during registration or ordering (name, address, email, phone, etc.) is accurate, complete, and up-to-date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Product Information, Pricing & Availability

  • All product descriptions, images, specifications are as accurate as reasonably possible. However, slight variations in color, texture, sizing may occur.
  • Prices are inclusive of applicable taxes (GST etc.), unless stated otherwise. Additional charges (shipping, duties, etc.) will be clearly indicated before checkout.
  • We reserve the right to modify or discontinue any product without notice. If a product is out of stock or no longer available after order placement, we will inform you and offer alternatives or cancellation.

4. Order Acceptance & Contract Formation

  • Your order represents an offer to purchase Products under these Terms. We reserve the right to accept or reject any order for any reason (stock issues, pricing errors, fraudulent activity, etc.).
  • A contract is formed only upon dispatch of the product, or when you receive an order confirmation with details.

5. Payment Terms

  • We accept payment methods as displayed on the site (credit/debit card, net banking, UPI, wallets, COD etc.). Payment is due at the time of placing the order, except in case of approved COD orders.
  • In case of COD orders, you must pay the full amount (including shipping / COD fee if any) at the time of delivery.
  • All payments are secure; we use recognized payment gateways that comply with applicable security standards.

6. Shipping, Delivery & Risk

  • Our Shipping Policy applies. Goods will be dispatched within the timeframe mentioned, subject to product availability.
  • Risk of loss or damage passes to you upon delivery (i.e., when you or an authorized person signs for the delivery).
  • You must provide valid address and identity details; LOFA is not liable for delivery failures due to incorrect or incomplete address.

7. Return, Refund & Cancellation Policy

  • The Return & Refund Policy applies (see separate document), but terms are incorporated here.
  • Cancellation requests must be made within [e.g., 24 hours] of placing the order and prior to dispatch. Once dispatched, cancellation is not possible.
  • All returns must meet eligibility criteria (unused, tags intact, within the return window, etc.).

8. Intellectual Property Rights

  • All content on the LOFA site (designs, graphics, logos, text, images, product photos) are our property (or licensed to us) and are protected under copyright, trademark, and other intellectual property laws.
  • You may download/view content for personal, non-commercial use only. You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, or exploit such content for any commercial purpose without our express written permission.

9. Limitation of Liability & Disclaimers

  • Products and services are provided “as is” and “as available.” We do not make warranties—express or implied—regarding quality, fitness for a particular purpose, accuracy, non-infringement, etc.
  • LOFA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your purchase, use of products, delays in delivery, or any other aspect. Our total liability in any case shall not exceed the value of the order you placed.

10. Indemnity

You agree to indemnify, defend, and hold LOFA, its officers, directors, employees, agents and affiliates harmless from and against any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or related to:

  • Your breach of these Terms;
  • Your misuse or negligent use of the products or Services;
  • Any violation of law by you;
  • Any content you submit or transmit via LOFA; etc.

11. Prohibited Uses & Misuse

  • You shall not use our Services for any unlawful purposes or in violation of these Terms. This includes but is not limited to:
  • Fraudulent activity, forging identities, attempting to gain unauthorized access;
  • Infringing the rights of LOFA or others;
  • Posting or uploading harmful, abusive, infringing, obscene or otherwise illegal content; 
  • Using automated means (bots, scrapers) to interact with the site without our permission.

12. Modifications to the Terms

  • LOFA may update or modify these Terms from time to time. Material changes will be notified via email or prominent notice on our website.
  • Revised Terms are effective immediately upon posting. Continued use of the Services after updates constitutes your acceptance of the updated Terms.

13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.
  • Any disputes arising from or connected to these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
  • You may also have recourse under applicable consumer protection statutes (e.g., Consumer Protection Act) and forums.

14. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

15. Miscellaneous

  • Entire Agreement: These Terms, along with the Privacy Policy, Shipping Policy, Return & Refund Policy, and any applicable order confirmations, constitute the entire agreement between you and LOFA concerning your purchase / use of Services.
  • No Waiver: If LOFA does not enforce any right under these Terms in one instance, that does not mean LOFA waives that right in the future.
  • Force Majeure: LOFA will not be liable for delays or failure in performance resulting from events beyond its reasonable control (natural disasters, war, strikes, etc.).
